Early Intervention Service

OFMA provides an Early Intervention Service to assist franchisees and franchisors to resolve disputes at an early stage and help avoid matters escalating unnecessarily. The service is confidential and free of charge. OFMA staff can:
  • Provide education and information to those covered by the Code about their rights and obligations under the Code - however, at no stage can OFMA provide legal advice;
  • Explain the steps to take to resolve a dispute under the Franchising Code of Conduct;
  • Provide a template for a Notice of Dispute;
  • Explain the mediation process and the role of the mediator;
  • Help a party to understand and think through its options;
  • Give suggestions about how one party might communicate effectively with the other to resolve the matter directly;
  • Suggest where a party might obtain franchising or legal advice;
  • Refer the party to other sources of assistance;
  • Where appropriate, in straightforward matters, liaise with both parties by telephone and email to help them better understand the issues and to explore options to settle the dispute.
